By creating an account, accessing, or using AgentData services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

AgentData provides data protection and management services through AgentData app. Our services include:

• Data storage and protection solutions
• Data management tools and features
• Access to our web application and associated services
• Customer support and technical assistance

As a user of AgentData, you agree to:

• Be at least 18 years old
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Use the service only for lawful purposes and in accordance with these terms
• Not use the service to store, transmit, or distribute illegal content
• Not interfere with or disrupt the service or servers
• Comply with all applicable laws and regulations

We reserve the right to suspend or terminate accounts that violate these terms.

You retain ownership of all content you create on AgentData. By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Create anonymized, aggregated statistics for improving the Service

AgentData does not store the data content you have locally. You are solely responsible for the content you create. Do not create content that infringes others' rights or violates any laws.

5.1 Free Tier

• The free tier provides access to core features with usage limits. Features unlock as you progress through levels.

5.2 Pro Subscription

• Pro subscriptions are billed monthly or annually
• Payments are processed securely through Paddle
• Subscriptions auto-renew unless cancelled before the renewal date
• Prices are in U.S. dollar and may change with notice

5.3 Cancellation

• You may cancel your subscription at any time from your account settings
• After cancellation, you retain Pro access until the end of your billing period
• No partial refunds are provided for unused time after the 14-day guarantee period

5.4 14-Day Money-Back Guarantee

• We offer a 14-day money-back guarantee on all Pro subscriptions (both monthly and yearly plans):

• If you're not satisfied with Pro, request a full refund within 14 days of your initial purchase
• Refund requests must be made by logging into your account and contacting us through the Support Center
• Refunds are processed within 5-10 business days to your original payment method
• Upon refund, your account will be downgraded to Free tier immediately
• This guarantee applies to new subscriptions only, not renewals

5.5 Payment and Billing

Payment processing is handled by Paddle, our authorized payment processor. By making a purchase, you agree to:

• Provide valid payment information
• Pay all fees associated with your subscription or purchases
• Authorize Paddle to charge your payment method
• Accept that all payments are subject to our Refund Policy

Prices are subject to change with notice. Continued use of the service after price changes constitutes acceptance of the new pricing.

All content, features, and functionality of AgentData, including but not limited to text, graphics, logos, software, and design, are owned by AgentData or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the service for your personal or business purposes. You may not copy, modify, distribute, sell, or lease any part of our services without prior written consent.

To the maximum extent permitted by law, AgentData shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or technical failures
• Unauthorized access to or alteration of your data
• Third-party actions or content

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid to AgentData in the twelve (12) months preceding the claim.

AgentData is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties regarding the accuracy or reliability of information
• Warranties that the service will meet your requirements

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, third parties, or our business interests
• Violates applicable laws or regulations

Upon termination, your right to use the service will immediately cease. We may delete your account and data in accordance with our data retention policies.

Any disputes arising from these terms or your use of AgentData shall be resolved through the following process:

1. Informal Resolution: Contact us at cogitogo@outlook.com to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing legal action
3. Governing Law: These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or through a notice on our website. Your continued use of the service after changes are posted constitutes acceptance of the modified terms.
